Terms and Conditions

Nappi Lawn & Landscape, LLC

Effective Date: March 2, 2026

These Terms and Conditions (“Agreement”) govern all services provided by Nappi Lawn & Landscape, LLC (“Company,” “we,” “our,” or “us”) to the client (“Client,” “you,” or “your”). By accepting an estimate, signing a contract, or authorizing services, you agree to the terms below.

1. Scope of Services

Services will be provided as outlined in the written estimate, proposal, or service agreement. Any work requested outside the approved scope will require additional written approval and may result in additional charges.

2. Estimates & Pricing

Estimates are valid for 14 days unless otherwise stated.
Pricing is based on current labor, material, fuel, and overhead costs.
The Company reserves the right to adjust pricing for unforeseen conditions, including but not limited to excessive overgrowth, hidden debris, access limitations, or site conditions not visible at the time of estimate.
Seasonal service rates may be adjusted annually with notice.

3. Payment Terms

Payment is due upon receipt unless otherwise stated in writing.
Late payments may incur a 5% monthly service charge (or maximum allowed by law).
The Company reserves the right to suspend services for unpaid balances.
Client agrees to pay all reasonable collection fees, court costs, and attorney fees associated with unpaid invoices.

4. Access to Property

Client agrees to:

Provide clear access to the service areas.
Remove vehicles, toys, pet waste, lawn furniture, hoses, and other obstacles prior to service.
Secure pets during scheduled service times.

The Company is not responsible for damage to items left in the work area.

5. Property Conditions & Underground Utilities

Client is responsible for marking or disclosing:

Underground utilities
Invisible fences
Irrigation systems
Landscape lighting
Private utility lines

The Company is not liable for damage to unmarked or improperly installed underground systems.

6. Weather & Scheduling

Services may be delayed due to:

Rain or severe weather
Unsafe site conditions
Equipment failure
Unforeseen operational issues

The Company will make reasonable efforts to reschedule promptly. Route scheduling is determined solely by the Company.

7. Lawn & Landscape Disclaimer

The Company is not responsible for:

Pre-existing lawn disease, fungus, pests, or poor soil conditions
Damage caused by drought, excessive rainfall, or natural events
Acts of nature including storms, flooding, or freeze damage
Plant or tree loss not directly caused by negligence

8. Satisfaction & Claims

Any service concerns must be reported within 48 hours of service completion. The Company will be given reasonable opportunity to inspect and correct verified issues.

Failure to notify within 48 hours constitutes acceptance of the work.

9. Limitation of Liability

To the fullest extent permitted by law:

The Company’s liability is limited to the amount paid for the specific service giving rise to the claim.
The Company shall not be liable for indirect, incidental, special, or consequential damages.
Under no circumstances shall liability exceed the total amount paid by Client for services rendered.

10. Termination of Service

Either party may terminate service with written notice.

The Company may terminate services immediately for:

Non-payment
Unsafe conditions
Harassment or abusive behavior
Breach of agreement

Client remains responsible for payment of services performed prior to termination.

11. Recurring Service Agreements

For weekly or bi-weekly maintenance:

Services will continue automatically unless canceled in writing.
Route placement is based on operational efficiency.
Skipped visits due to Client request may not result in prorated discounts unless approved in writing.

12. Material & Plant Warranty (If Applicable)

Unless specifically stated in writing:

No warranty is provided on plant material due to variables outside Company control.
Hardscape or installation warranties must be stated in the project contract.

13. Force Majeure

The Company shall not be liable for delays or failure to perform due to circumstances beyond its control, including but not limited to acts of God, labor shortages, supply chain disruptions, or governmental restrictions.

14. Governing Law

This Agreement shall be governed by and construed under the laws of the State of Ohio.

Any disputes shall be resolved in the appropriate courts located in Lake County, Ohio.

15. Entire Agreement

These Terms and Conditions, along with any written estimate or contract, constitute the entire agreement between the parties. No verbal statements shall modify this Agreement.

16. Acceptance

Approval of estimate, payment of invoice, or authorization to begin work constitutes acceptance of these Terms and Conditions.
